Debate sparks on details of new Fecafoot document

Since last week, football players and others have been scrutinizing three documents made available to the members of the AG December 2013. It contained a draft of statutes (44 pages, 109 blogs), a draft electoral code (14 pages, 31 blogs) and of the new draft statutes of the decentralized leagues (38 pages, 94 blogs).

Many criticisms were raised on the Statute of the Fecafoot, pointing out the vagueness of the statutory provisions relating to guardianship and the blur nature of the statutes regarding the holiday situations.

The relationship between the Fecafoot and MINSEP (Department of Sports and physical education) may continue to be ambiguous since it is mentioned in article 2 paragraph 1 that it shall receive "the delegation from the Minister in charge of Sports '.

Paragraph 4 of the same article states that: "Fecafoot can inform the Minister in charge of Sports on the functioning of its institutions. The great innovation of these texts is the creation of an Arbitration football Tribunal.

It will be responsible for ensuring "the settlement of internal disputes between Fecafoot, its members, players, leaders, match officials and agents of players and matches that do not fall under the jurisdiction of other judicial organs.

Moreover, in the scrutiny, the physical presence of the delegates to vote is required. Thus, no vote by proxy by one of the 72 delegates of the GA will be taken into consideration. Article 23, paragraph 8 of the draft statutes of Fecafoot states that, 'only delegates present may vote, they cannot vote neither by correspondence nor by proxy.

Another point is the issue of vacancy of the Presidency and the Executive Committee. Puzzled by the last election in 2013, it was settled in articles 38 and 46 of the statute because in the event of vacancy, it is 1st Vice President who is vested with full powers to execute orders.

Article 35 excludes Executive Committee (15 members), the young representatives of football, players, coaches and referees. "Yet, it is part of the body management of Fecafoot. If the term of office of the president is an Olympiad (four years), it has not clearly specified the number of times it could be renewed.

The "famous" article 4, which specifies outgoing Board members, on individual basis, of the full members of the regional, departmental assemblies and boroughs has also disappeared.

As concerns the electoral code, the texts of Fifa, have been met, even if there was no progress of choice in the document. It will now be difficult to have relatives within the Election Commission, in accordance with the provisions of article 3 (basic principles) paragraph 4.b.

On the number of sponsors required for a candidate for the Presidency, it has regressed from 10 to 8.

On the decentralized leagues, everything has been reviewed from the base. The decentralized leagues now have statutes, another step forward proposed by the Commission for the revision of Fecafoot texts. "League is subordinate to the Fecafoot. It provides that "the Organization and the management of football within its territorial jurisdiction as captured in texts now await validation in the General Assembly on August 23.
