Michel Ngapano, DG of Hysacam vindicated

The judicial decisions handed down Wednesday by the Court of appeal in the Littoral marked the end of six years of trial between the Director General Hysacam and Dr. Ngoula, owner of Clinique du Berceau over the building which used to be a hospital.

Michel Ngapanou, Director General of the company for health and safety of Cameroon (Hysacam) was found not guilty Wednesday, September 17, 2014 by the Court of appeal in the Littoral in the case between Tchinou and Dr. Ngoula about the building which housed the services of the Clinique du Berceau in Akwa.

They accused him of complicity in the destruction of property, theft and looting. To justify his acquittal, judges of the Court of Appeal indicated that the facts against this pattern of society were not established.

The civil party lawyers claimed the sentence of deprivation of liberty against the Director General of Hysacam as well as the payment of a sum of 1,481,804, 404 Francs Cfa as damages.

In the same vein, his co-accused, Mes Tchamabe, Kalla Francis, Penda Alain were also freed of charges of flights of sanitary equipment. But unlike the Hysacam Director, they fared with a sentence of three months with a stay of three years after having been found guilty of destruction of property.

They must also jointly and severally pay the costs of a total of 914,700. Of all accused, only Me Ernest Djoumbe, was found guilty of fake facts showing the abuse of trust and thus was sentenced to an imprisonment of six months for a period of three years. In addition, the latter is supposed to pay the costs of a total of 42 million Cfa Francs.

Seven million Francs Cfa in damages will go to the family Tchinou (owner of the disputed building), including five million in property damage and moral damage caused two million while Dr. Ngoula will receive a sum of 35 million Cfa Francs, or 10 million for damage, ten million for moral harm and fifteen million shortfall.

Interested parties have 10 days from the pronunciation of the verdict to appeal in cassation.These court decisions have been made in the absence of Michel Ngapanou who had testified under oath and pleaded not guilty at the previous hearing, 04 September 2014.
